Privacy Policy

Your privacy matters to us. This Privacy Policy explains how BreathWise, operated by PhuongTrinh, based in Da Nang, Vietnam (“we” or “us”), collects, uses, and shares information about you when you use our mobile app and website (together, the “Services”). PhuongTrinh is the controller responsible for your personal data, including for users in the European Economic Area, Switzerland, and the United Kingdom. We do not sell your personal information, and we do not use your data to track you across other companies’ apps or websites.

We may update this Privacy Policy from time to time. If we make changes, we will revise the date above and, where appropriate, provide additional notice.

1. Information We Collect

The BreathWise app and website collect the following:

  • Contact info: your name and email address, used to create your account and sign you in.
  • How you sign in: you can create an account with your email address, or by signing in with Apple, Google, or X. When you use a third-party sign-in, we receive basic profile information from that provider — typically your name and email address, according to the settings and permissions you grant on that provider. We use this only to create and secure your account. We do not post anything to your third-party accounts, and we do not receive your password for those accounts. Sign in with Apple may provide a private relay email address if you choose to hide your email.
  • Account and app content: information you choose to provide, such as your password, language preference, goals, meditation preferences, and any reviews, ratings, or reflections (check-ins) you submit in the app.
  • Community content: messages, reactions, and your chosen display name and avatar that you post in community rooms. This content is social by nature and is visible to other members (see “How We Share Information” below). Please do not share private information you don’t want others to see.
  • Health data: with your permission, heart rate (your heartbeat) is read from your device’s health app (such as Apple HealthKit) so the app can guide and measure your breathing and meditation sessions. This data is used only to provide app functionality.
  • Usage and device info: the sessions and content you use, app version, device model and operating system, and similar technical information needed to operate and improve the Services.
  • Diagnostics: crash data and related diagnostic information, used for analytics and to provide customer support.

If you purchase a subscription, the purchase is processed by Apple, and we receive transaction details (such as the product, price, and renewal status) from Apple. We do not receive or store your full payment card details.

2. How We Use Information

We use the information we collect to:

  • provide, maintain, and improve the Services;
  • create and secure your account and sign you in;
  • guide and measure your breathing and meditation sessions;
  • process your subscription and provide customer support and service-related messages;
  • diagnose and fix problems, including by analyzing crash and diagnostic data; and
  • comply with our legal obligations and protect against fraud and abuse.

We do not use your data for advertising or to track you across other companies’ apps or websites.

3. Health Data

Health data, including heart rate, is sensitive information. We process it only to provide app functionality—guiding and measuring your breathing and meditation sessions. We never sell your health data, never use it for advertising, and never share it with third parties for advertising or data-mining. You can revoke the app’s access to your device’s health app at any time in your device settings.

4. How We Share Information

We do not sell your personal information. We share information only in the following limited circumstances:

  • Other members: when you post in a community room, your messages, reactions, display name, and avatar are visible to other members of that room.
  • Apple: subscriptions are processed by Apple under Apple’s own terms and privacy policy.
  • Service providers: companies that perform services on our behalf, such as cloud hosting and storage, crash reporting and analytics, email delivery, and customer support, under obligations of confidentiality.
  • Legal and safety: when we believe disclosure is required by law or legal process, or is necessary to protect the rights, property, or safety of our users or others.
  • Business transfers: in connection with a merger, acquisition, or sale of assets.
  • With your consent: when you direct us to share information, such as by using a “share” feature.

5. Cookies

Our website uses only essential cookies needed for the site to function, such as remembering your language preference. We do not use advertising or cross-site tracking cookies.

6. Data Retention

We retain personal data for no longer than is necessary for the purposes for which it is processed, unless a longer retention period is required or permitted by law. When you delete your account, we delete or anonymize your personal data, except where we are required to retain it by law.

7. Your Privacy Rights

Subject to applicable law, you have the right to access, correct, export, or delete the personal information we hold about you, to object to or restrict certain processing, and to withdraw consent. You can:

  • update your account information directly in the app under Settings;
  • delete your account and associated data in the app under Settings > Account > Delete Account; and
  • contact us at phuongtrinh1402x@gmail.com to exercise any of your rights.

We will not discriminate against you for exercising your rights. If you are in the European Economic Area, Switzerland, or the UK, you also have the right to lodge a complaint with your local data protection authority. Residents of certain US states (such as California) have rights to access and delete their information; we do not sell or share personal information or use it for targeted advertising.

8. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

9. International Data Transfers

We are based in Vietnam and process information there. We and our service providers may also process your information in other countries, which may have different data protection rules than the country in which you live. Where required by law, we put appropriate safeguards in place for international transfers, such as Standard Contractual Clauses.
